Date: Mon, 1 Feb 1999 13:23:09 -1000 From: ramsey@math.hawaii.edu (Tom Ramsey) Subject: THE BAEHR CASE CONTINUES Plaintiffs' Supplemental Brief Is Available On The Web After the Nov. 3 election, Hawaii's Supreme Court asked the Baehr case litigants for supplemental briefs on the prospective and retrospective effects of the new constitutional amendment on the disposition of the lawsuit. Charles Cooper replied on behalf of the state just before Christmas. On behalf of the three couples asking for marriage licenses, Dan Foley and Evan Wolfson responded Jan. 22. Today, Feb. 1, Cooper is expected to respond to the plaintiffs' brief. The plaintiffs' brief argues that the new constitutional amendment is prospective only, and that it does not address the equal protection aspects of Kevin Chang's 1996 ruling in the Baehr case.
