Be enacted by the Legislature of the State of Kansas Section 1. Each school district that provides pupils with instruction on human sexuality and MD& Shall: (a) Teach that abstinence from sexual activity outside of marriage is the expected standard for all school age children. All classes that teach sex education and discuss sexual intercourse shall emphasize that abstinence is the expected norm in that abstinence from sexual intercourse is the only protection that is 100% effective against out-of-wedlock and unwanted teenage pregnancy, sexually transmitted diseases, and acquired immune deficiency syndrome (AIDS) when transmitted sexually; (b) teach that the best way to avoid sexually transmitted diseases and other associated health problems is to establish a mutually faithful monogamous relationship in the context of marriage; (c) provide for exclusion of pupils from participation in classes scheduled for instruction on AIDS and its prevention; (d) at least one month before teaching AIDS prevention education in any classroom, conduct at least one presentation during weekend and evening hours for the parents and guardians of pupils concerning the curricula and materials that will be used for such education. The parents and guardians shall be notified directly by the school district of the times, dates, and places of presentations and that the curricula and materials are available for inspection. No pupil shall be required to participate in AIDS prevention and sex education if the pupil's parent or guardian objects in writing to the participation. Refusal to take or participate in such course or program shall not be reason for suspension or expulsion of such pupil. Each class or course in comprehensive sex education offered in any of grades five through 12 shall include instruction on the prevention, transmission and spread of AIDS; (e) design the curriculum for AIDS prevention education to teach pupils which behaviors place a person dangerously at risk of infection with the human immunodeficiency virus (HIV) and methods to avoid such risk including, at least, the dangers of drug abuse, especially that involving the use of hypodermic needles and the dangers of sexual intercourse, with or without condoms; (f) provide course material and instruction that is age appropriate, teaches honor and respect for monogamous marriage, stresses that pupils should abstain from sexual intercourse until they are ready for marriage, and includes a discussion of the possible emotional and psychological consequences of preadolescent and adolescent sexual intercourse outside of marriage and the consequences of unwanted adolescent pregnancy; (g) stress that sexually transmitted diseases are serious possible hazards of sexual intercourse. Pupils shall be provided with statistics based on the latest medical information citing the failure rates of condoms in preventing AIDS and other sexually transmitted diseases; (h) advise pupils of the laws pertaining to their financial responsibility to children born in and out of wedlock; (i) advise pupils of the circumstances under which it is unlawful for a person to engage in sexual acts with another person pursuant to the statutory provisions contained in article 35 of chapter 21 of Kansas Statutes Annotated; and (j) emphasize that pupils have the power to control personal behavior. Pupils shall be encouraged to base their actions on reasoning, self-discipline sense of responsibility, self-control, and ethical considerations for one's self and others. Sec. 2. This act shall take effect and be in force from and after its publication in the statute book.
