It will receive a title from the Attorney General's office by August 14th. It will appear on the ballot November 4, 1996 if the Idaho Citizens Alliance, the proponents, are able to gather 41,325 valid signatures by July, 1996. Declaration of Public Policy. By Voting "Yes" on this Initiative, We, the People of Idaho, do hereby Enact the "FAMILY AND CHILD PROTECTION ACT," declaring our support for protection of Idaho's families and young children, and prohibiting official government promotion of unlawful homosexual behavior which threatens our families and children, as follows: Section 67-8002. By voting "YES" on this initiative, the people of Idaho hereby prohibit official government promotion of homosexual behavior. A government agency, board, commission, council, department, district, institution, or elected or appointed official of the state of Idaho, or of any political subdivision thereof: (a) Shall not formally declare any individual or group, solely on the basis of homosexual behavior, preference, or orientation, to comprise an officially sanctioned or recognized "minority," or otherwise establish or grant to such individual(s) any special, exclusive, or preferential status, treatment, or classification under law. (b) Shall not establish, set aside, or reserve exclusively for any individual or group, solely on the basis of homosexual behavior, preferences, or orientation, any number or quota of jobs, scholarships, contracts, grants, or other special rights, privileges, or benefits under law. (c) Shall not expend tax dollars or other public moneys to fund any official government policy, proclamation, or program for the express purpose of promoting, advocating, endorsing, or encouraging homosexual behavior. (d) Shall not, in a public school, officially authorize, sanction, or sponsor any statement, communication, expression, or teaching which expressly promotes, advocates, endorses, or encourages homosexual behavior as prohibited by Idaho law: and shall require that any discussion of homosexual behavior therein occur only on an age-appropriate basis as defined by the local school board. (e) Shall not extend to a homosexual couple or partner the legal status, recognition, benefits, or privileges of the institution of marriage. Section 67-8003. Effective immediately upon a "YES" vote. A "Yes" vote by a simple majority of those voting on this initiative in the general election held on November 4, 1996, shall be required to enact the "Family and Child Protection Act" into law, which on that date shall be in full force and effect immediately upon such a vote having been cast. Should any portion of this act thereafter be found to be unconstitutional or unenforceable, in whole or in part, all remaining provisions shall remain in full force and effect.
