	Hawaii Marriage Case on "All Things Considered"

In Hawaii:  KHPR, 88.1 FM and on other locations, 
            early broadcast:  12:00 noon or 1:00 pm
            later broadcasts:  roughly 5:00 to 6:30 pm

	Ina Jaffe (please excuse spelling) interviewed
attorney Dan Foley for a story to be broadcast today on
"All Things Considered."  She will probably review the
status of Baehr v. Miike and discuss the proposed Hawaii
constitutional amendment which will be on the ballot in
November of 1998.

      The proposed constitutional amendment is a separation
of powers amendment: shall the legislature have the POWER to
limit marriage to opposite sex couples?  Absent this amendment,
the marriage decision will be left to the courts in Hawaii.
The amendment does not ban same-gender marriage (although that
is what the enemies of same gender marriage intended, and that
is how the amendment is usually described in the media).  For
legal and technical reasons, the fight about the constitutional
amendment should be (and is) separate from the fight for same
gender marriage.
