Following please find a series of bills now up for consideration by the
Hawai`i Senate Judiciary Committee on Monday, February 3rd.  I had resisted
keyboarding this stuff, but find it a useful tool to digest the material,
and also productive in the sense that it can be shared with the others.

STATE OF HAWAI`I


A BILL FOR AN ACT
PROPOSING AN AMENDMENT TO ARTICLE I, SECTICN 5, OF THE 
CONSTITUTION OF THE STATE OF HAWAI`I TO AMEND THE DUE 
PROCESS AND EQUAL PROTECTION CLAUSE.


BE IT ENACETED BY THE LEGISLATURE OF THE STATE OF HAWAI`I

 1     SECTION 1.   The purpose of this Act is to propose an

 2 amendutent to article I, section 5, of the Constitution of the

 3 State of Hawai`i to clarify that same sex marriages are not

 4 constitutionally protected and to define marriage as a legal

 5 relationshlp between a male and a female.

 6     SECTION 2.   Article I, section 5, of the Constitution of the

 7 State of Hawai`i is amended to read as follows:

 8                  "DUE PROCESS AND EQUAL PROTECTION

 9     Section 5.   No person shall be deprived of life, liberty or

 lO property without due process of law, nor be denied the equal

 li protection of the laws, nor be denied the enjoyment of the

 12 person's civil rights or be discriminated against in the exercise

 13 thereof because of race, religion, sex or ancestry.

 14    <begin underscore> Nothing in this section or any other section of this

 15 constitution shall be interpreted to create a constitutional

 16 right to marriage between two people of the same gender.

 17 Marriage is reserved as a legal relationship that has been 

 18 sanctioned by the State between a man and a woman as husband and

 1 wife.  Marriage maybe subject to reasonable regulation by the

 2 State.<end underscore."

 3     SECTION 3.  The question to be printed on the ballot shall

 4 be as follows:

 5     "Shall the Due Process And Equal Protection Clause be

 6     amended to clarify that there is no constitutional right to

 7     marriage between parsons of the same gender, and to define

 S     marriage as a legal relationsnip that has been sanctioned by

 9     the State between a man and a woman as husband and wife,

 10    which may be reasonably regulated by the State?"

 11    SECTION 4.  New constitutional material is underscored.

 12    SECTION 5.  This amendment shall take effect upon compliance

 l3 with article XVII, section 3, of the Constitution of the State of

 14 Hawai`i.
