Just a couple of years ago your editorials stated that the marriage should not be limited to opposite sex couples as you based your position on equal protection and historical prohibition of marriage of couples of different races and religions. Many times you wrote that the legislature should allow the courts to finish the process to assure that equal protection was in fact a reality in Hawaii. Now your editorials believe that it is OK to legislate organized religious discrimination, hatred and fear of Gay people out of equal protection rights. Do you now believe people should have equal protection based upon race, religion, and sex? Did you believe so and act accordingly when these issues were being visited by the suffrage movement and women' rigth to vote, Brown Vs the Board of Education, Roe vs. Wade? We all seem to get and believe in equality after we have collectively been a part of the perpetuation that equal should not be equal for all - all the time. Several phone conversations between leaders yesterday. If the last version - agreed upon for amendment - passes we will lose a great deal. Even with the committee report making it sound much better it i too much. Baeh V Miike would probably die outright because it was filed solely on license issue and drew in rights and benefits with subsequent briefs. The license issue and right of legislature to decide licenses and rights would legally stop case unless ruling came before vote. Most believe is legislature passes an amendment this session, even with 51% that the supreme court will hold off decision clearly indicating that passage of amendment would moot case. Not looking good. My belief at the rap-up meeting last Saturday early morning about House making statement they would give in on HB118 in the press is happening. Senate will become more hard pressed to be able to change anything in amendment since they stated publicly that was already agreed upon. There are black clouds looming in Honolulu on the IRS witching day. Opposition has been very quiet I might add - at least publicly. We need mail, email, and faxes to our supportive legislators more than ever. Of course, they could repeal the benefits even if they went into effect in 1997, but people don't cry foul as loudly about benefits they've never had as they do about benefits they've actually had and are losing. Of course I'm sick to see that they seem to have reached agreement on the constitutional amendment itself. Personally, I think the Supreme Court is wrong that marriage itself is not a civil right. Joy Fisher <><><><><><><><><><><><><><><><><><><><><><><><><><><><><><><><><><><><><> TOM RAMSEY: Duplicity and Complicity DUPLICITY AND COMPLICITY Saturday, Speaker Joe Souki crowed that Hawaii's House was willing to grant "reciprocal beneficiaries" 90% of the rights under Hawaii law that are enjoyed by married couples (health insurance was the most important exclusion, and the effective date is about two years away). Speaker Souki was proud that this package was better than that which existed in any state, or even the world [the latter is false]. Yesterday, Monday, the House trumpeted its concession on health care benefits (the details are messy, and controversial as usual). Silence---from Mormon leaders Jack Hoag and Debbie Hartman, and Roman Catholic priest Mark Alexander, the leaders spearheading the opposition to same-gender marriage. In private, they've told legislators that they'll implicitly accept domestic partnerships, ANYTHING to stop same-gender marriage. Even Jay Sekulow, Pat Robertson's legal beagle, has given domestic partnership the nod. Mr. Sekulow, like the rest of us, hung around Hawaii's Capitol until the early morning hours Friday night, awaiting news of the outcome of House-Senate negotiations. Even Mike Gabbard, a follower of Hare Krishna and leader of the anti-gay-marriage Alliance for Traditional Marriage, is for HB 118 (the "reciprocal beneficiary" bill). Right now, HB 118 may have 60 rights in it, but please don't take that count seriously (especially since ideas about the bill change hourly). I'm left wondering: do the supporters of domestic partnership in Brazil, where the Roman Catholic Church is a vigorous opponent, know that the same church is bobbing and weaving in Hawaii (i.e., supporting domestic partnership in Hawaii)? Do the donors to Pat Robertson's 700 Club know that their dollars are supporting Jay Sekulow into the wee hours of the morning in Honolulu, winking and nodding at domestic partnership? I think of the hard fought campaign in California to get a domestic partnership with just THREE rights---only to be vetoed by their current jerk of a governor. On what side were the Christian Coalition, the Mormon leaders, and the hierarchy of the Roman Catholic Church in that fight? Because some gay people in Hawaii have asked in all sincerity for the most traditional of arrangements, namely marriage with all its rights and obligations, our religious enemies are now supporting untried social experiments involving "partial marriages" and FEWER obligations (neither the Hawaii House nor the Senate have put divorce obligations into their "reciprocal beneficiary" packages). Moreover, our enemies have extended this package to "incestuous" relationships (mothers and sons, etc.). Can the effects of prejudice be more clearly illustrated, for the effect it has on the bigot? If there's NO agreement by midnight, the legislature could still vote on an amendment this year, and they could do it in the last hour of session (like last year), but they'll have to get a majority of both houses *two sessions in a row* to get the amendment on the ballot in 1998. View of Hawaii's #1 Homophobe April 16, 1997 Catholics, Mormons, Anti-Gay Stop Promoting Homosexuality's Mike Gabbard Encourage State House to Support "Gay Family Health Benefits" by William E. Woods The deadline is Friday April 18 for an amendment to declare the Hawaii State Constitution off limits for establishing any marriage rights for same-sex couples. With language already agreed upon by conferees from the House and Senate, the only sticking points are centered around a domestic partnership measure that conjures up some benefits for any two people who cannot otherwise be legally married. In an unexpected turn, mainland funded anti-Gay groups here in Hawaii are endorsing, some say pushing, for House conferees to agree to Gay family health insurance benefits and anything else that the House has been holding back, as long as the agreed upon amendment is passed. While The Pope and the official Roman Catholic Church is using every political maneuver possible to prevent any recognition of non-traditional relationships in Brazil, their spokesperson here in Hawaii has been prodding the House leadership to adopt the Gay family health benefits as a part of our state's minimal recognition of Gay couples. Father Mark Alexander, official lobbyist of the Hawaii Catholic Diocese has told conferees of both houses that he supports HB118 and has encouraged the House to go the extra step of providing Gay family health insurance as requested by the Senate. This is not like the covert communications of last year when Alexander told the public that he was against domestic partnership recognition of Gay couples and then secretly conveyed to the House leadership that he supported such provisions. This year he has talked with the legislative leadership and is giving the same message to national reporters. In the same vain, Debi Hartmann, Mormon and co-leader of Hawaii's Future Today, echoed Alexander's position on Gay family health insurance to legislators and reporters. Most shocking is the anti-Gay charlatan Mike Gabbard, who has created numerous fundraising organizations to prevent Gay Americans from gaining equal protection under the law. Gabbard has also begun active support for Gay family health insurance and the whole package of domestic partnership rights put forth by the Senate. Just a couple of days left on the newest deadline to have an amendment on the general election ballot in 1998 and all the most visible opposition to Gay rights have adopted positions for Gay family rights as long as they can have an amendment that would deny us any equal protection towards actual marriage. And Just What Do They See In The Amendment? The only thing left in this amendment is that marriage could be reserved by legislative decree to only between one man and one woman. However, because of the committee report (legislative intent) written into the measure the right to equal protection under the constitution for same-sex couples has been preserved. Meaning that should the portion of the amendment be held up constitutionally to only allow for marriage licenses to opposite sex couples, same-sex couples would keep in tact the second portion of the Baehr Vs. Miike lawsuit and prevail on constitutional grounds to gain each and every right of marriage, but simply be required to call it something other than marriage. All the benefits but not the name. "Is a rose a rose by any other name?" Not coming close to marriage in terms of federal and other states benefits, having all the tangible benefits in Hawaii would move Hawaii to the fore again in civil rights legislation. Clearly the strategy becomes after experience with 100% rights and benefits, but calling it something like domestic partnership to begin active legislative lobbying to move it over to actual marriage since the legislature will be sole source of that right. With the passage of the amendment and if it should pass constitutional muster same-sex marriage will be on the legislative agenda every year till it becomes a reality. The legislature may be trying to punt the issue to the ballot box, but that is only a band-aide fix as they will be sole focus in the ongoing future until marriage is preserved as a right for all couples. Sidebar Article: Hawaii's #1 Homophobe: Mike Gabbard by: William E. Woods Who is Gerald Michael Gabbard? Known to most in Hawaii as merely Mike Gabbard, he is known for his homophobia educational and recruitment programs that he began in Hawaii in 1991. His first organization he created is called "Stop Promoting Homosexuality." Although this organization is not registered as an organization with our Gross Excise Tax office (State Taxation Office) or with the State Department of Commerce and Consumer Affairs Gabbard has solicited and distributed funds through it. He has since added additional fundraising activities under various organizational names as: "Stop Promoting Homosexuality - Hawaii"; "Stop Promoting Homosexuality - America"; "Stop Promoting Homosexuality - International"; "Let's Talk Straight"; "Common Sense Now"; and "Traditional Marriage Alliance." A version of this latter name has since been registered. Gabbard's original foray into attacking Gays with hate messages was via his first radio show called "Stop Promoting Homosexuality - Common Sense Now-Hawaii" on K108 Radio. His direct answers to a caller on that program resulted in a picket and boycott of his restaurant "The Natural Deli " by a group called "The Gang of Four or Five" [of which I am proud to have been a member]. When queried by a caller of the soon to be "Gang," on an actual broadcast, Gabbard stated he would not hire Gay job applicants in his business. His broadcast position was in direct opposition to the intent of Hawaii's employment non-discrimination law. The boycott and protest in front of the restaurant began three days later. After only 12 days of boycott, Gabbard lost 95% of his customers and closed down the business. Following the successful boycott of Gabbard's restaurant the radio station was boycotted because it did not honor a non-discrimination and ethical broadcast policy. Such a policy had it been in effect would have prohibited the broadcasting of the Gabbard show which put out erroneous and misleading information to promote specific discrimination and hatred of Gay people. Within 21 days, the radio station removed the offensive program, adopted the fair and accurate broadcasting policy, and provided the boycotting group a one-hour time-slot for one year as a corrective action. Some time later, Gabbard moved his radio show to KGU Radio and another boycott began. More than a dozen advertisers pulled their advertising from that station and the offending radio show was removed from the airwaves by station management. The program was stopped by the station in less than 18 days, but the station never related the pulling of the show as a result of the successful boycott. Gabbard and his various organizations continue to raise money locally and nationally by creating a wave of hysteria and fear about equality of Gay Americans. His greatest coup was to become a key speaker at a pre-Presidential Rally in 1996 in Iowa that demanded presidential candidates sign a pledge to oppose same-sex marriage. Seen as a pawn in conservative politics, radical religious right groups have demonstrated support for Gabbard's homophobia promotion activities. This author still remembers Mike Gabbard radio broadcasting his list of reasons why Gay men and women should not have civil rights. One that impressed me the most with his ultimate justification to deny rights. "Lesbians have 17 times more traffic accidents than other drivers." So, no civil rights because they need driver's education?? And of course, no such information is available by any data review source traffic records do not contain any information on sexual orientation. The point he's making concerns the additional cost of medical insurance that would be borne by the state if the current reciprocal beneficiaries bill is passed, requiring a "family plan" be made available. The more distance between the two sides the better, as were hanging on by a thread now, and that thread is fraying rapidly Of course, it is illegal for the state to ask a het employee prior to employment if he/she is married with/without children, and the state has no qualms about extending such benefits once the het employee is hired and then marries. But what the hay, that's a separate and unequal story, no?
