Pete Wilson, Governor The California State Capitol Sacramento, CA 95814 RE: SB 1239 - HIV Testing and Exposure Notification: OPPOSE Dear Governor Wilson: I am writing to express my strong opposition to SB 1239 and to ask you to veto this bill which is now on your desk. This bill would permit mandatory testing of a patient's blood in the case of a potential occupational exposure at the request of a health care worker or "first responder." SB 1239 is unnecessary and, if enacted, would represent a dangerous precedent for mandatory HIV testing in California. It does nothing to reduce the risk of HIV infection to health care workers or first responders. Only following universal precautions for infection control, which are already mandated, will reduce exposure risk. State law already provides health care workers, who are involved in the diagnosis and treatment of a patient, access to all HIV information in the patient's medical record. SB 1239 contains loopholes which would allow substantially broader testing of patients than is represented by its sponsors, that would permit violation of confidentiality, and which would provide expanded access to a patient's medical records. SB 1239 is a bad bill and, for the sake of the citizens of California, I strongly urge you to veto it. Very truly yours,
